1. Overview

Welcome to Pawwsy (“Pawwsy”, “we”, “us”, “our”). These Terms of Service (“Terms”) apply to your use of our website, online store, and any related content, tools, products and services (together, the “Services”). Our store is powered by Shopify.

By visiting our site, creating an account, or purchasing from us, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you should not use the Services.

2. Using our Services & customer accounts

You confirm that you are at least the age of majority in your country of residence and that you have permission to allow any minors using devices you own or manage to access our Services.

To place an order or create an account, you may be asked for information such as your name, email address, billing details and shipping address. You promise that this information is accurate and up to date, and that you are authorised to use the payment method provided.

You are responsible for keeping your account details (such as login links or email access) secure and for all activity that happens under your account. You may not transfer or sell your account to another person.

3. Our products

We do our best to show our products clearly and accurately. However, colours and details may look different on your screen due to device settings or lighting, so slight variations may occur.

We do not guarantee that any product will fully meet your expectations. Product descriptions, prices and availability may change at any time without notice. We may discontinue products or limit quantities for any person, household, region or order.

4. Orders

When you place an order, you make an offer to purchase. We reserve the right to accept or decline any order at our discretion. An order is only accepted once payment has been successfully processed and we send you an order confirmation.

Please check your order carefully before confirming, as we may not be able to change or cancel it once it has been accepted. If we cannot accept, need to change, or must cancel an order, we will contact you using the email address or other details provided.

All purchases are subject to our Refund & Returns Policy You confirm that your purchases are for personal or household use only, and not for resale or export.

5. Prices, payment & billing

Prices, discounts and promotions can change at any time. The price you pay is the price shown at checkout when you place your order, as confirmed in your order email. Unless clearly stated otherwise, prices include VAT but exclude shipping and any customs or import charges.

You agree to provide current, complete and accurate billing and contact information, and to update it when needed so we can process your orders and contact you if required.

By submitting a payment method, you confirm that:

• the payment details are true, correct and complete;
• you are authorised to use that payment method; and
• you will pay all charges incurred at the advertised prices, including any applicable taxes and shipping.

6. Shipping & delivery

Estimated delivery times are provided for convenience only and are not guaranteed. Delays can occur due to carriers, customs, weather or other circumstances beyond our control.

Once your order has been handed over to the shipping carrier, the risk of loss or damage passes to you. If a parcel appears lost or damaged, please contact us and we will assist you where possible in line with our Refund & Returns Policy.

7. Intellectual property

All content on the Services – including text, graphics, photos, logos, icons, product images, video, and their layout and design – is owned by Pawwsy, our partners or our licensors and is protected by applicable intellectual property laws.

You may use the Services only for personal, non-commercial purposes. You may not copy, modify, distribute, publish, sell, or create derivative works from any part of the Services without our prior written permission. All rights not expressly granted are reserved.

“Pawwsy” and related names, logos and designs are trademarks of Pawwsy or our affiliates. Shopify’s names and logos are trademarks of Shopify. Other names and logos may be trademarks of their respective owners and may not be used without permission.

8. Optional tools & third-party services

From time to time we may provide access to tools or services from third parties (for example, payment providers, review apps or tracking tools). These are provided “as is” and “as available”. We do not control these tools and are not responsible for their content, terms or performance.

Your use of any third-party tools, websites or services is entirely at your own risk and subject to the terms and privacy policies of those third parties. Any questions or complaints about third-party products or services should be directed to the relevant provider.

9. Relationship with Shopify

Pawwsy is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Pawwsy.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sale between you and Pawwsy, including any injury, damage or loss resulting from purchased products or services. You expressly release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with Pawwsy.

10. Privacy

Personal data we collect through the Services is handled in accordance with our Privacy Policy. Because our store is hosted by Shopify, certain information about your use of the Services is also processed by Shopify and its service providers in order to operate and improve the platform.

By using the Services, you acknowledge that you have read our Privacy Policy (and, where applicable, Shopify’s privacy notice) and that your personal data may be transferred, processed and stored in other countries in accordance with those policies.

11. Feedback & reviews

If you share reviews, photos, suggestions or other content with us (“Feedback”), you grant Pawwsy a worldwide, royalty-free, perpetual licence to use, reproduce, adapt, publish and display that Feedback in any media for the purpose of operating, improving and promoting the Services.

You confirm that you own or control any rights in your Feedback, that it does not infringe the rights of others, and that it is lawful and appropriate. We may monitor or remove Feedback that we believe is abusive, unlawful, misleading or otherwise inappropriate, but we are not obliged to do so.

You are responsible for any Feedback you submit and for ensuring it is accurate and not misleading.

12. Errors & corrections

Sometimes there may be information on the Services that contains typographical errors or inaccuracies (for example in product descriptions, pricing, promotions or availability). We reserve the right to correct any errors, change information or cancel orders if information is inaccurate at any time, including after you have placed an order.

Sections that by their nature should survive termination (including Intellectual Property, Feedback, Disclaimers, Limitation of Liability, Indemnification, Governing Law and this clause) will continue to apply.

15. Disclaimers

The Services and all products are provided “as is” and “as available”. While we strive to keep information accurate and up to date, we do not guarantee that the Services will be error-free, uninterrupted or secure, or that any defects will be corrected.

To the fullest extent permitted by law, we exclude all warranties, whether express or implied, including any implied warranties of merchantable quality, fitness for a particular purpose and non-infringement. Nothing in these Terms affects any statutory rights you may have as a consumer under applicable law.

16. Limitation of liability

To the extent permitted by law, Pawwsy and our directors, employees, partners and service providers will not be liable for any indirect, incidental, special or consequential damages, or for loss of profits, revenue, data or goodwill, arising from your use of the Services or any products, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim relating to the Services or any product will not exceed the total amount you paid to us for that product or order, except where a higher amount is required by mandatory law.

17. Indemnification

You agree to indemnify and hold harmless Pawwsy and our partners, officers, employees and service providers from any claims, damages or expenses (including reasonable legal fees) arising out of your breach of these Terms, your violation of any law or the rights of a third party, or your misuse of the Services.

18. Severability

If any part of these Terms is found to be invalid or unenforceable, that part will be enforced to the maximum extent permitted by law and the remaining provisions will remain in full force and effect.

19. Entire agreement & waiver

These Terms, together with our policies referenced here (such as our Privacy Policy and Refund & Returns Policy), form the entire agreement between you and Pawwsy regarding the Services and replace any prior agreements.

If we do not enforce a right or provision under these Terms, this does not mean we waive that right or provision.

20. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations under these Terms at any time, for example in connection with a business transfer.

21. Governing law

These Terms and any disputes arising out of or related to the Services will be governed by the laws of the country where Pawwsy is established, unless mandatory consumer protection laws in your own country require otherwise. You and Pawwsy agree to submit to the non-exclusive jurisdiction of the competent courts in that country.

If we make material changes, we will notify you in accordance with applicable law (for example by email or a notice on our website).
